Britney Spears has approved her ex-husband Kevin Federline’s plan to move their two children to Hawaii.
Federline, 45, has sole custody of Sean Preston, 17, and Jayden, 16, and plans to move out of Los Angeles with his children and wife Victoria Prince in August.
A source exclusively told DailyMail.com that the 41-year-old pop icon “has always been a loving and supportive mother” and has never opposed her children’s relocation plan, despite Federline threatening to undertake legal actions for an alleged lack of response by Spears to the relocation request.
The source said: ‘Britney loves her children, has always supported them and wants them to be happy.
“An icon aside, loved and respected by millions around the world, she has been a loving and supportive mother, faithfully supporting her children.”
The source also criticized Federline for creating a “fake feud” when Spears never interfered with his plan to move his children to Hawaii.
this comes later Federline gave his ex Spears a deadline to approve his plan to move their children to Hawaii – or threatened to go to court to have a judge sanction the measure.
Federline’s lawyer, Mark Vincent Kaplan, told TMZ that he had asked Spears’ lawyer, Mathew Rosengart, “multiple times” to send a letter or email stating that the pop star is “okay with the move.” , but has not received anything.
Kaplan said Federline plans to move out on Aug. 1 and has to arrange housing while his wife has a job offer at a local university but hasn’t accepted it yet.
Kaplan added that there should be “no issues” with the two children, saying Federline has 100% legal custody and 100% de facto physical custody, stating that Spears has not seen her children in “more than one year”.
Kaplan said he had given Rosengart a Friday deadline to respond, after which he will file legal papers seeking a move order.
The measure could not be sanctioned without a formal resignation from the star or a court order. DailyMail.com reached out to lawyers for Federline and Spears for comment at the time.
It comes as Britney’s marriage to Sam Asghari is said to be in ‘deep trouble’ with the couple having ‘screaming matches’.
And now Britney could face more heartache if her two children move hundreds of miles to Hawaii in July.
Kevin reportedly got his lawyer, Mark Vincent Kaplan, to send a letter to Britney’s lawyer, Mathew Rosengart, asking if he would be happy for his children to settle permanently in Hawaii.
TMZ says Kevin’s lawyers expect to hear back within the week. If she refuses, she’ll go to a judge’s court and ask for permits, but sources don’t think she’ll go that far.
A source told the publication that the reason behind the move is that Victoria has a job offer, Kevin can get a job as a DJ, while the boys have a more private life away from the busy LA scene.
They added that Jayden could take classes remotely, while Sean would have graduated by then.
MailOnline has contacted representatives for Britney and Kevin for comment.
Britney has previously shared her heartbreak over having a strained relationship with her beloved children.
Last year, the singer admitted that “a part of her had died” as she hadn’t seen her children for six months and they didn’t attend her wedding to Sam.
Meanwhile, Kevin said “the kids have decided they’re not going to see her right now,” noting that it’s been a tough few months for them since a judge ruled to end their 13-year conservatorship.
It’s a difficult time for Britney, whose marriage is reportedly on the brink of failure.
britney and sam29 years old, got married last June in a lavish ceremony but TMZ now claims that Britney has ‘got physical’ with Sam as marital tensions have boiled over.
They also report that they have had frequent ‘shouting matches’, in which security had to intervene at times.
Ahead of the publication’s documentary on Britney, which is set to premiere on Monday, May 15, they further state that Sam rarely stays together at home.
Representatives for Sam and Britney have been contacted for further comment.
It comes after Britney posted an oblique comment about relationships on her Instagram last week.
The pop superstar reposted the text, which read: “In every relationship, there’s the person who falls asleep instantly and the other person who stays up wondering how that’s possible.”
The post was credited to the Thoughts From Aisle 4 blog, written by Marlene Kern Fischer.
It was not clear from Britney’s comment why exactly she chose the post, or if she was supposed to be referring to her marital situation with husband Sam.
Last month, the couple was rumored to be overcoming marital problems when they were photographed without their wedding rings.
A source told DailyMail.com that despite the reports, all was well between the couple.
“Everything is fine,” the source said, adding: “Sam is working on a project and is on vacation with [manager] cade [Hudson].’
Asghari shared a snippet of him walking with Britney, smiling alongside the blonde star as they posed in front of a gorgeous view of the ocean.
‘Walk with my wife,’ Asghari wrote, inviting his three million followers to see him and his wife.
The Toxic singer looked busty in a low-cut pink tank top while her aspiring action star wore a blue Versace gym top.
Sam flashed her dazzling smile for the camera as Britney played a game of sticking out her tongue.
Prior to her marriage to the fitness guru-turned-actor, Spears was married to dancer Federline from 2004 to 2007.
And before her infamous three-year marriage to “K-Fed,” she had a whirlwind Las Vegas affair with childhood friend Jason Alexander in 2004 that was later called off.
Britney said ‘I do’ to her partner of five years, Sam, at their Thousand Oaks home last June and was stunned in a Versace dress.
The wedding ceremony, which was the singer’s third, was not attended by her estranged relatives, father Jamie Spears, mother Lynne Spears and sister Jamie Lynn Spears.
Also missing were their sons Sean Preston and Jayden James.
